Benefit
Benefit at the level of ordinary wages during the leave (monthly cap of KRW 2,200,000, in effect Jan. 1, 2026). For workers of priority support companies, the government supports the first 60 days (within the actual leave days), and for workers of large companies the government pays only the portion beyond 60 days (up to 30 days).
Who is eligible
Female workers who had a miscarriage or stillbirth during pregnancy. For the benefit, an employment insurance insured period of 180 days or more before the leave end date and a medical certificate (showing the pregnancy period) are required.
When to apply
Request from the day of the miscarriage or stillbirth. Days granted by pregnancy period: within 15 weeks (raised to 10 days for within 11 weeks, in effect Feb. 23, 2025) 10 days, 16~21 weeks 30 days, 22~27 weeks 60 days, 28 weeks or more 90 days. Apply for the benefit from 1 month after the leave starts until within 12 months after it ends.
How to apply
Request miscarriage or stillbirth leave from the employer, then apply for the benefit at Work24 (고용24, https://www.work24.go.kr). Documents: medical certificate, ordinary wage materials, company payment records.
Important notes
Within 12 months after the leave ends (within 30 days after the reason ends for unavoidable reasons).
Note
For leave of 10~60 days at large companies, the company pays ordinary wages (no government benefit). From Feb. 23, 2025, leave in early pregnancy (within 11 weeks) was expanded from 5 days to 10 days. Artificial abortion surgery is subject to some restrictions, such as cases permitted under the Mother and Child Health Act - check individually.
