- Benefit
- Up to 6 days per year. Currently (until Nov. 26, 2026) the first 2 days are paid and the rest unpaid / from Nov. 27, 2026, the first 4 days are paid and the remaining 2 days unpaid. From Nov. 27, unfavorable treatment because of using the leave is punishable by imprisonment of up to 3 years or a fine of up to KRW 30,000,000.
- Who is eligible
- Workers receiving infertility treatment (artificial insemination, IVF, etc.) and its preparation (infertility tests, ovulation induction, etc.). Whether workplaces with fewer than 5 employees are included should be confirmed with the Ministry of Employment and Labor (Article 18-3 of the Equal Employment Opportunity and Work-Family Balance Assistance Act).
- When to apply
- Usable from the preparation stage such as infertility tests and ovulation induction through treatment and rest immediately after treatment. Apply to the employer before use (a document stating the leave dates and application date). The expansion of paid days takes effect Nov. 27, 2026.
- How to apply
- Submit a leave application to the employer. Supporting document: instead of a medical certificate, the Ministry of Health and Welfare's infertility couple treatment cost support decision notice can be used (from May 2026). Inquiries: Employment Equality Counseling Office (고용평등상담실) 1551-9811.
- Important notes
- Note that leave used before Nov. 27 is based on 2 paid days. Employers may not disclose a worker's use of infertility treatment leave without consent (confidentiality obligation in effect since Oct. 22, 2024).
- Note
- May be used in one-day units. Both male and female workers may apply (statutory leave for workers; each spouse separately). The employer pays wages for the paid days, but for workers of priority support companies (small and medium-sized enterprises), employment insurance supports the Infertility Treatment Leave Benefit (난임치료휴가급여) (separate item). The 6 days per year are calculated from the date of joining the company.
